Jason Bitzer has written the following. As it's legal, the words are brief:

It has been two years in the process and now that it is out in the public eye by default it is best the facts are presented as I see that the community of bodyboarding is split on the issue.

"They arrogantly used Bitzer's name and likeness without his permission. When he wouldn't agree to their ridiculously low royalty terms, they sued him to keep from having to pay any royalties at all, at even a fraction of the rate that other athletes are paid, while at the same time they have received millions of dollars in profits. They did this in contravention of the laws of the States of Cali Hawaii and NJ and most other jurisdictions in the United States.
